What Are My Rights?

Guarantee of Lawful and Secure Processing of Personal Data

Artion processes your personal data in a fair and lawful manner. This includes the following guarantees:

  • Personal data is only processed in accordance with the described and justified purposes of this Privacy Statement.
  • Personal data is only processed to the extent that it is adequate, relevant, and not excessive.
  • Personal data will only be retained as long as necessary to fulfill the described and justified purposes in this Privacy Statement.
  • The necessary technical and security measures have been taken to minimize the risks of unlawful access to or processing of personal data. In the event of a breach of its information systems, Artion will immediately take all possible measures to minimize damage.

Right to Access/Rectification/Deletion of Your Personal Data

With proof of your identity as a user, you have the right to request confirmation from Artion as to whether or not your personal data is being processed. When Artion processes your data, you also have the right to access the collected personal data. If you wish to exercise your right of access, Artion will respond within one (1) month after receiving the request. The request can be made via registered mail or by emailing support@artion.eu.

Inaccurate or incomplete personal data can always be corrected. It is the responsibility of the user to first make adjustments to inaccuracies and incompleteness. You can exercise your right to rectification by submitting a supplementary statement to Artion. Artion will respond within one (1) month after receiving the supplementary statement.

You also have the right to request the deletion of your personal data without undue delay. You can only exercise this right to be forgotten in the following cases:

  • When the personal data is no longer needed for the purposes for which it was originally collected;
  • When the personal data was collected based on obtained consent and no other legal basis exists for processing;
  • When you object to the processing and no overriding compelling legitimate grounds for processing exist;
  • When the personal data was processed unlawfully;
  • When the personal data must be deleted in accordance with a legal obligation.

Artion will assess the presence of any of the above cases.

Right to Restriction of/Objection to Processing Your Personal Data

The user has the right to obtain a restriction of processing of their personal data:

  • For the period Artion needs to verify the accuracy of personal data, in case of dispute;
  • When the data processing is unlawful and the user requests restriction of processing instead of deleting the personal data;
  • When Artion no longer needs the personal data for processing purposes, and the user requires the personal data for legal proceedings;
  • For the period Artion needs to assess the presence of grounds for deletion of personal data.

The user also has the right at any time to object to the processing of their personal data. Artion will stop processing the data unless it can demonstrate compelling legitimate grounds for processing that override the user’s right to object.

If the user wishes to exercise these rights, Artion will comply within one (1) month after receiving the request. The request can be made via registered mail or by email to support@artion.eu.

Right to Data Portability

The user has the right to obtain the personal data provided to Artion in a structured, commonly used, and machine-readable format. Additionally, the user has the right to transfer this data to another processing controller when the processing is based solely on the consent obtained from the user.

If the user wishes to exercise this right, Artion will comply within one (1) month after receiving the request. The request can be made via registered mail or by email to support@artion.eu.

Right to Withdraw My Consent/Right to File a Complaint

The user has the right to withdraw their consent at any time. Withdrawing consent does not affect the lawfulness of processing based on consent prior to its withdrawal. Additionally, the user has the right to file a complaint regarding the processing of their personal data by Artion with the Belgian Commission for the Protection of Privacy.
